Decree n ° 2-20-270 of 21 rejeb 1441 (March 16, 2020) relating to the methods of execution of the expenses carried out by the ministry of Health was published in Gazette n ° 6866 (official translation).
In the context of a state of health emergency, this decree provides for derogations from the regulatory texts in force concerning the execution of certain expenses incurred by the Minister of Health and the sub-officers authorized by him, specifically:
- by way of derogation from the provisions of paragraphs 1 and 2 of article 88 of decree n ° 2-12-349, expenditure by purchase order is made by expenditure transaction;
- by way of derogation from the provisions of paragraph 5 of article 88 of the aforementioned decree n ° 2-12-349, expenditures by purchase orders are made without limitation of ceiling;
- by way of derogation from the provisions of section III of chapter IV of decree n ° 2-12-349, the negotiated contracts may be concluded without prior publicity, without prior call for competition and without production of an administrative certificate;
- by way of derogation from the provisions of decree n ° 2-07-1235, the expenditure executed in application of this decree is not subject to the control of the regularity of the expenditure commitments.
This decree remains in force until it is repealed.
