Rules on Employment in the Private Sector (For non-citizen employees)

Ministerial Decision No. 279/2020 on  employment of non-citizen employees in the private sector during the COVID-19 crisis has been issued changing rules on transfer of employees, salary payments and recruitment. The Ministerial Decision was issued on 26 March 2020 and Federal Law No. 8/1980 has been considered in this context. All companies registered in the Ministry are obliged to work in accordance with its provisions which regulate labour relationships between employers and non-citizen employees who are authorized to work in a company, in order to preserve the interests of the both parties during the period when precautionary measures are being implemented to limit the spread of COVID-19. The companies affected by the precautionary measures are expected to, in agreement with any non-citizen employee, implement a teleworking system. Ministerial Decision No. 181/2020 has also been issued to deal with the organization of remote work in private sector facilities during the period of application of precautionary measures to reduce the spread of the new coronavirus.
